DDCA member gets court’s mercy for assaulting policemen

New Delhi: A Delhi and District Cricket Association (DDCA) member whoassaulted cops during Indian Premier League (IPL) match in an inebriated situation in 2010 got the relief from Delhi Court.

Tees Hazari Court freed Atinder Jain on probation after he accepted that he had pick up the fight with Delhi Police sub-Inspector and a constable who were on duty near corporate box while the match between Delhi Daredevils and Rajasthan Royals was going on in the stadium.

The court freed him on a personal bond of rupees 50,000 and surety of like amount on the condition that he behavior throughout the year will be good with other. If he found to be involved in any crime within the year, he will have to serve the jail term of 10 days.

Earlier, Magistrate court had also taken a lenient view on him as he had accepted the crime. Junior Judge had sentenced him to undergo 10 days jail term and levy fine of rupees one thousand.

Atinder challenged the sentence before session Judge on the ground that he won’t mind with paying the fine, If he has to undergo jail term for the offense, it will be a big stigma on his social image. convict said his children are living abroad and he often goes there to meet them. If he has to go jail, it will create visa related problem to him. his passport is also going to expire sooner. He will also face problem in renewable after the sentence.

Atinder, an executive member of DDCA  council for long, said he always take part in election and win. If he has to serve the sentence he will be barred from fighting the election as well.

Special CBI judge MK Nagpal, who hears the review petition, said there is no illegality or infirmity in the verdict of the lower court. However, after considering the social and family related issue it is pertinent to mention here that convict had no previous feud with the said police persons. He is having no previous criminal record. Giving jail term will create social problem to the convict. In my opinion,  justice will be done if the convict is freed on Probation. 

Prosecution had said that during the match he created ruckus under the influence of alcohol. When police personal tried to intervene, he beat them as well. However, he got injuries in the melee as well.
